             FULL TERMS AND CONDITIONS OF THE YELLOW BRICK ROAD COMPETITION TERMS & CONDITIONS (‘Terms’)

  1. The promoter is Yellow Brick Road Holdings Limited (ABN 44 119 436 083; ACN 119 436 083) of Mezzanine Level, 1 Chifley Square, Sydney NSW 2000, phone 02 8226 8200, a company incorporated in Australia under the Corporations Act 2001 (Cth), trading as Yellow Brick Road (Promoter).
  2. Entry into this Customer Feedback Survey draw is open to all Australian residents 18 years of age or over at the time of entry. Employees, management, agents, in-house contractors of the Promoter or its related entities (or immediate family members of such people) or of retailers or agencies associated with the Survey and the resultant draw are ineligible to enter (Eligible Entrants)
  3. To enter and be eligible to win, Eligible Entrants must complete an online survey undertaken by Yellow Brick Road Holdings Limited, found at https://www.surveymonkey.com/r/YellowBrick_RoadCustomerFeedback?Number=[Number_value].
  4. Information on how to enter and prize details form part of these Terms. Participation and completion of the Customer Feedback Survey is deemed acceptance of these Terms.
  5. By completing the Survey, you represent that you are eligible to enter the Competition.
  6. The Survey commences at 9:00am (AEDT) on Monday, 1 April 2019 and closes at 5:00pm (AEST) on Monday, 15 April 2019.
  7. Only one entry is permitted per person. Eligible Entrants who complete more than one Survey will be regarded as having entered into the Draw once only. Eligible Entrants can enter the Competition only in their own name.   
  8. Entry into the Competition shall be deemed to be accepted at the time an Eligible Entrant completes the relevant Survey.
  9. This Competition is a game of chance.
  10. The Promoter reserves the right, at its sole and absolute discretion to deem any irregular, incomplete, incorrect or incomprehensible Surveys that do not comply with these Terms or Surveys containing offensive or defamatory comments or which breach any law or infringe any third party rights (including intellectual property rights), as invalid (Invalid Entries).
  11. A winner will be randomly drawn, through a computerized draw (Draw), to take place at 2:00pm (AEST) on Wednesday, 17 April 2019 at MDSA, Level 2, 40 Yeo Street, Neutral Bay NSW 2089, from all eligible entries received, as outlined in condition 2 of these Terms.
  12. There will be one Draw for one cash prize of $500 (incl. GST) (Prize).
  13. Invalid Entries cannot win the Prize.  
  14. The Promoter will review the Drawn entry to confirm that it is not an Invalid Entry. If the Drawn entry is an Invalid Entry, a further entrant will be drawn and reviewed in the same manner.The Draw will come to an end once a valid Eligible Entry is identified.
  15. The Promoter will notify the winner by phone and email within 2 business days from the Draw (i.e. on or before Friday 19 April 2019).
  16. The Prize will be sent via bank transfer to the winner, in accordance with these Terms, within 28 days of the Draw (i.e. on or before, Wednesday, 15 May 2019).
  17. Prizes are not transferable, substitutable or exchangeable (including any unused portion) and all other costs associated with the Prize including, but not limited to bank charges, are the winner’s sole responsibility.
  18. The Promoter reserves the right to cancel or change the Competition at any time throughout the Survey period without notice, subject to approval by relevant State authorities.
  19. Decisions of the Promoter on all aspects of this Competition are final and binding and not subject to any discussions.
  20. Entry into the Competition is free, but all costs and charges imposed by an entrant’s internet service provider or other technology provider is the responsibility of the entrant.
  21. The Promoter may prohibit any person’s participation in this Competition, cancel or suspend the Prize (or part thereof) if the Promoter considers that an entrant has conducted himself / herself in a manner, which may diminish the Promoter’s name or reputation, is in bad faith, or is designed to gain an unfair advantage, is fraudulent or otherwise contrary to law or these Terms, or is otherwise inappropriate.
  22. If the Promoter is unable to contact the winner to claim fulfilment of the Prize within 3 months of the Draw or the winner cannot provide suitable proof as may be required under these Terms, the Promoter will conduct a computerised re-draw at the same time and location as the original draw on Wednesday, 24 July 2019, subject to approval by State regulations (Re-Draw) and any winner of the Re-Draw will be notified by email or phone (i.e. on or before Friday 26 July 2019).
  23. The Promoter reserves a right to publish information on the winner of the re-draw on its website. If applicable, the prize will be delivered to the Re-Draw winner in accordance with clause 16, within 28 days of the Re-Draw (i.e. on or before Wednesday, 21 August 2019).
  24. The Promoter reserves the right to request the winners to provide proof of identity, residency and/or age before awarding the Prize. Proof of identification, residency and/or age considered suitable for verification is at the discretion of the Promoter. If a winner cannot provide suitable proof, in the timeframe required by the Promoter, that winner will forfeit the Prize and no substitute will be offered. 
  25. The Promoter accepts no responsibility for any Surveys not completed for any reason during the Survey Period.
  26. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) assumes no liability (including negligence) for any personal injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to the following:
  1. any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
  2. any theft, unauthorised access or third-party interference;
  3. any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason;
  4. any variation in Prize value;
  5. any tax liability incurred by a winner or entrant;
  6. redemption of a Prize; and/or
  7. participation in the Competition.
  1. It is a condition of accepting the Prize, that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  2. The Promoter collects personal information about entrants to include Eligible Entrants in the Competition and where appropriate, award the Prize. If the personal information requested is not provided, the entrant cannot participate in the Competition. By participating in the Competition, each Eligible Entrant consents to disclosing his / her personal information to the Promoter and the Promoter using, and disclosing that personal information to the relevant authorities in the relevant States, the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the competition, for the following purposes:
    1. conducting the Competition;
    2. contacting the Eligible Entrant in relation to the Competition;
    3. publishing the winner's names and State / Territory of residence in accordance with these Terms and as required under relevant legislation;
    4. improving the Promoter's or the Promoter's or its related entities' goods and services; and
    5. in the Promoter's and its agencies' case, the purposes set out in the Promoter's privacy policy found at https://www.ybr.com.au/privacy-policy.
  3. Each entrant provides this consent until such a time as he / she withdraws consent by giving notice to the Promoter. Entrants can also gain access to, update or correct any personal information held by contacting the Promoter at the details listed in these Terms. The Promoter's privacy policy also contains information about how Eligible Entrants can make a complaint.  All personal information will be stored at the office of the Promoter or its related entities. 
  4. By entering the competition and providing an email address, each Eligible Entrant agrees to consent to receiving future emails relating to the Promoter's or its related entities publications, products, services and events.
  5. If for any reason this Competition is interfered with in any way or becomes incapable of running as reasonably anticipated, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, then, subject to any written directions from any State regulatory authority, the Promoter reserves the right to disqualify any individual who tampers or interferes with the Competition’s process, disqualify entries that do not comply with these Terms, take any reasonable action that may be available, and to cancel, terminate, modify or suspend the Competition.
